Fool Me Hundreds of Times: Who Gets to Clean Up ACORN?

Imagine: In the days following the public revelations of the accounting scandal at Enron, then-CEO Ken Lay convened a news conference. He forcefully expressed his disgust with the actions of his subordinates and vowed to begin “cleaning house” at the company. Taking a few turns to slam the company’s critics and the reporters who had uncovered the scandal, he stressed that, this time, there would be a thorough revamp of the company. He even said that people would be fired! Reassured, reporters, lawmakers and regulators shrugged and went back to their daily lives.

Substitute Bertha Lewis for Ken Lay and ACORN for Enron, in this hypothetical situation, and you’ll have a pretty good idea of what was asked of us at Lewis’ tour-de-force theatrical performance at the National Press Club earlier this week. She alternated between attacking her critics, expressing disgust with the actions of her employees caught on tape by James O’Keefe and Hannah Giles and vowing to pursue a lawsuit against the filmmakers for capturing on film her employees’ misdeeds. Oh, and by the way, she really, really—she means it this time—intends to “clean house” at ACORN.
Washington Post columnist Dana Milbank captured the surreal tableau best:
But Lewis, in playing the victim, is her own worst enemy. Forget the film of the pimp and prostitute: Watching a film of Lewis’s performance yesterday would probably be enough to cause lawmakers to cut off ACORN’s federal funding.
Which raises a question: Why does Bertha Lewis get to “clean house” at ACORN? Even today, actions have consequences. The fact that the employee behavior exposed by O’Keefe and Giles happened on her watch—and she has been less than forthcoming about it, by the way—would alone be enough to get most CEO’s booted. Worse, though, is the implication that Lewis has been complicit in ACORN’s missteps for a long time. To paraphrase Ronald Reagan, “Bertha Lewis isn’t the solution to ACORN’s problems. Bertha Lewis is the problem.”
Bertha Lewis has been a long-time leader of ACORN. She became CEO—“Chief Organizer” in the ACORN vernacular—in June, 2008. Around that time, an attorney hired by ACORN, Elizabeth Kingsley, delivered a detailed, 15-page memo to ACORN’s board, highlighting actual and potential problems with ACORN’s operations. Kingsley made a series of very specific recommendations to “clean house” within ACORN. In the 15 months since the memo was delivered, I’m not aware of any efforts ACORN has made to implement these reforms.
Also in 2008, ACORN’s board appointed a special committee to investigate a long-covered up embezzlement scandal. (Ms. Lewis was part of the cover-up.) The embezzlement had been recently revealed by the New York Times. This special committee, and other ACORN leaders, pressed for a full forensic audit of the organization. For this transgression, under the leadership of Bertha Lewis, they were booted out of ACORN. No audit of ACORN has ever been released to the public.
Last week, Wade Rathke, founder of ACORN and victim of Lewis’ 2008 palace coup, made a rare appearance in DC to promote his recent book. Big Government contributor Maura Flynn attended, filmed his talk and asked questions. The interview is interesting. Rathke said they decided to cover-up the embezzlement because ACORN leadership feared its enemies would “weaponize” the scandal against them. He also conjectured that, based on the recent scandal engulfing ACORN, that decision looks to have been the right one.
Which raises several questions for Lewis, since she was a co-conspirator in the embezzlement cover-up: Are you going to truly “clean house” in ACORN or only in those areas that have been publically revealed? Are you focused on rooting out actual corruption or only the corruption the public knows about? Do you see your employees’ transgressions as potential “weapons” your opponents will use against you or actual misdeeds that need to be expunged from ACORN? Can I remind you that several of your offices believed they were assisting an underage sex-trafficking ring? And, they were happy to do so.
Lewis makes a nod to public sentiment in acknowledging the potential criminal activity, yet continues to devote a considerable amount of her time to attacking O’Keefe and Giles and some vast conspiracy against ACORN. (The most devastating take-downs of ACORN have been produced by Jon Stewart and Jay Leno, both absent from my vast right-wing conspiracy membership database.) Worse than this, though; she hasn’t been entirely forthcoming about the videos we have all seen. She continues to claim the videos are doctored, but it has been almost a month since we released the first video. I haven’t seen any evidence from you that these were doctored. Surely, roughly thirty days is enough time to build that case. We released the full audio recordings and transcripts of the interviews.
Second, we initially released videos from Baltimore and Washington, DC. Lewis said then that the filmmakers were thrown out of ACORN offices in “San Diego, Los Angeles, Miami, New York and Philadelphia.” We have so far released videos from two of those cities. Was she lying? Or, simply misled by her staff?
The most troubling reservation, however, has to do with the “independent” panel Lewis appointed to guide ACORN through its current troubles. All are long-time ideological allies of ACORN. It asks too much of us to consider them independent. John Podesta is a long-time ally of ACORN. He was instrumental in the creation of Media Matters (for Bulgaria), who is currently exhausting any credibility it ever had spinning for ACORN. Andy Stern, as head of SEIU, has shoveled millions of dollars to ACORN over the years. His own organization has publically stated that they have “cut ties to ACORN,” yet there Stern remains deep in ACORN’s inner circle. Former Massachusetts Attorney General Scott Harshbarger, the newly appointed “ACORN Czar,” is a kindred fellow-traveler. His thirst for political power may even exceed Lewis’, as he seems to have been willing to put an innocent man behind bars for two decades to further his own political career. Much more about all of these individuals will be revealed soon. (No, we haven’t begun to release all the information we have.)
So, is Bertha serious about wanting to “clean house?” Has she had a genuine “road to Damascus” moment and is now committed to reform. Color me skeptical, but here are three quick things she could do to begin to restore the public’s trust:
Disclose all of ACORN’s affiliates. Publically reveal the names of every entity that is part of the ACORN ‘family.” I’ve heard there are 100, 200 and even 400 different organizations. Please give the public the full list.
Order full audits of every ACORN affiliate. ACORN has been entrusted with millions of dollars of local, state and federal funds. Reassure the public that these funds haven’t been misspent. If they have been misspent, admit it and discipline the offenders. Release the audits to the public, with proprietary or personal information redacted.
Appoint a real independent panel. A review panel made up of your political allies is not independent. It is akin to appointing the foxes to review the henhouse. It has become accepted in recent years that boards of directors need a lot of “outside” directors to oversee operations. No institution would benefit as much from this as ACORN.
Three simple steps, but, giant leaps to restoring any integrity ACORN may have once enjoyed. Lewis, you can pick the high road or the low road. If she continues on her current path–the low road–then she’s gotta go.

Feds on H1N1: Sorry, We Don’t Have a Line-Item For That

In Washington, a crisis isn’t real until it has its own budget line-item. The $3-odd trillion we’ll spend this year is, apparently, a ‘best-case’ scenario. Anything unusual happen; a hurricane, earthquake, wild-fires, or, say, a possible flu epidemic, and we’re going to need extra or ’supplemental’ appropriations. Our federal budget, it seems, is so lean and tight, there simply isn’t any extra money lying around to cover the unexpected ‘crisis.’
This scenario played out yesterday when Dr. Tom Frieden, director of the Centers for Disease Control and Prevention testified before Congress on the still-anticipated H1N1 ‘pandemic’:
The government’s disease prevention chief said Tuesday that a new vaccine to prevent the spread of the H1N1 virus is expected to be widely successful but warned that cuts to state and local public health programs could hamper a nationwide effort to administer the shots.
Thomas Frieden, director of the Centers for Disease Control and Prevention, told the House Oversight and Governmental Reform Committee that “decades of underinvestment in public health and public health infrastructure” and the recent furloughing and firing of public health workers as a result of the economic downtown could make it “even more challenging to implement the vaccination program.”
Well, yes, vaccines do cost money. If only we had some money for health and disease prevention. Oh wait:

HHS Secretary Sebelius Announces Cornerstone Funding of the $650 Million Recovery Act Community Prevention and Wellness Initiative
Creating ways for healthful lifestyle habits to be the natural first choice for Americans is the goal of a $650 million initiative of the U.S. Department of Health and Human Services (HHS). The funds from the American Recovery and Reinvestment Act will be used to increase physical activity, improve nutrition, decrease obesity, and decrease smoking in U.S. communities.
And then, on the same day Dr. Frieden was doing his best Oliver Twist before Congress:
$120 Million for States Made Available as Part of Recovery Act Community Prevention and Wellness Initiative
Now, the H1N1 is one of the more anticipated, slow-moving ‘pandemics’ in history. It hasn’t even really hit and it seems like old news. Surely, some of that $650 million in grants for ’healthy choices’ could have been used to, you know, actually keep people healthy.

Pro-Free Market Parties Romp to Victory in Germany

German Chancellor Angela Merkel won a resounding reelection in today’s balloting in Germany. That was mostly expected. What wasn’t expected was the absolute drubbing suffered by SPD, the labor/left party. Until this election, Merkel’s conservatives were in an uneasy, ‘grand coalition’ with the SPD. Those days are over. Now Merkel’s conservatives will form a government with the pro-free market (libertarian) FPD party. Hmmm…hints of things to come?:
Together with the FDP, Mrs Merkel is expected to push for a new era of deeper economic reforms and tax cuts for Europe’s biggest economy. Mrs Merkel’s Christian Democratic Union (CDU) and the FDP benefited from dissatisfaction over spiralling national debt and stagnant income levels.
The CDU retained its position as Germany’s largest party with 33.5 per cent and the Free Democrats jumped to 15 per cent.
The result marked a humiliating blow for Germany’s venerable Social Democratic Party, which took just 22.5 per cent.
Predictions of a tight outcome were confounded by frustrated voters embracing Mrs Merkel’s case for a stronger hand to deal with Germany’s long-term financial problems.

Chancellor Merkel’s party support actually dropped slightly from the last election. However, the FDP, the pro-market, libertarianish party almost doubled their support. And, the labor/left collapsed. Totally.

ACORN Recap Video: Pictures Worth Two Weeks of News

Way back in March–long before the James and Hannah “pimp and ho’ road show”– the House Subcommittee on the Constitution, Civil Rights and Civil Liberties, held a hearing where serious fraud allegations were raised against ACORN. Rep. John Conyers pressed the subcommittee Chair, Rep. Jerry Nadler, to hold hearings on the charges, calling them “serious.” Rep. Nadler demurred, but assured the public that he would hold hearings if he received “credible evidence” of fraud.
It is a sure bet that Rep. Nadler and I agree on very, very little. However, I would hope we’d agree that video footage of possible conspiracy by ACORN employees to commit tax, mortgage or immigration fraud in five different jurisdictions, on both coasts of the US, would clear just about any bar that could be imagined for “credible evidence.”

Taxpayer-Funded Propaganda: The ABC’s of the NEA Conference Call

Today, Big Hollywood released a full audio recording and transcript of the NEA conference call. A full review of the call reveals several new and more troubling aspects to what transpired on the August 10th phone call. What is inescapable is that the origin of the call reaches into the highest offices of the White House. It is clear, from the transcript, that the call was orchestrated by the Office of Public Engagement, whose Director, Valerie Jarrett, is among the closest advisors to President and First Lady Obama. It is also apparent that Ms. Jarrett’s office directed the involvement of the National Endowment for the Arts and the Corporation for National and Community Service, two independent federal agencies. (This is important, as neither is officially part of the executive branch.)

At the very beginning of the call, the general ‘moderator’ of the call, Michael Skolnik, political director for Hip-Hop mogul Russell Simmons, explains the genesis of the call:
I have been asked by people in the White House and folks in the NEA about a month ago in a conversation that was had. We had the idea that I would help bring together the independent artists community around the country.
This is important, because in the immediate aftermath of the breaking story, the NEA has tried to state that a ‘third party’ organized the call. This clearly isn’t true. The e-mail invitation to the call was sent from Mr. Sargent’s government-provided NEA e-mail address. In addition, as the transcript reveals, Mr. Sloknik was “asked†by the White House and NEA to organize the call.

Mr. Skolnik goes on to comment to the participants:
…about the role that we played during the campaign for President and also during his first 200 some odd days of his presidency and the President has a very clear arts agenda and has been very supportive of using art and supporting art in creative ways to talk about some of the issues that we face here in our country and also to engage people.
Throughout the call, the speakers, all public officials, except Mr. Skolnik, make references to the campaign work done by call participants. The call is conducted with the presumption that all participants were active supporters during the Presidential campaign. This is troubling since the call was organized by a non-partisan government agency.
Especially since Mr. Skolnik goes on to comment:
And I think all of us who are on this phone call were selected for a reason…You  are the ones that, if you create a piece of art or create a campaign for a company, and tell our country and our young people sort of what to do and what to be in to; and what’s cool what’s not cool.
He then adds:
…the goal of this phone call [instigated at the request of the White House and NEA] is to get involved in things that  we’re passionate about as we did during the campaign but continue to get involved in those things, to support the President’s initiatives…â€
If the call ended here, it would be troubling enough. To recap quickly, there were 21 different artist organizations on the call, all of whom, it seems, were active in the Obama presidential campaign. Sixteen of the organizations had recently—within the previous 150 days—received grants from the NEA. To sum up, the White House and NEA had organized a call of 21 artistic groups who had been active in the presidential campaign, most of whom had recently received federal support, to explore ways they could become involved in supporting the President’s agenda.
The most troubling aspect of the call came with the introduction of Buffy Wicks, with the White House Office of Public Engagement. Ms. Wicks is a long-time progressive activist. Prior to working for the Obama campaign, she was political director  for WakeUpWalmart and a lobbyist for the United Food and Commercial Workers Union. Both of these organizations funneled hundreds of thousands of dollars to ACORN, to help support their organizing and protest campaigns. Ms. Wicks also worked on the Howard Dean campaign in 2004 and was a legislative aide to Rep. Bob Filner, one of only 75 Congressmen to vote in favor of ACORN continuing to receive federal funds. Ms. Wicks is also the lead White House official on United We Serve, the parent organization of the Serve.Gov web portal.
She described her White House role at the Office of Public Engagement:
We have about 20 folks and we work under Valerie Jarrett, she’s one of our fantastic leaders, and Tina Chen.
It is sometimes hard for outsiders to navigate the DC nomenclature. Here’s a quick synopsis: Ms. Wick’s mention of Valerie Jarrett indicates to all participants on the call that this discussion has Ms. Jarrett’s stamp of approval. As one of the more important advisors to President Obama, the message to call participants cannot be more clear.
Ms. Wick begins her discussion—again on a call organized by the non-partisan NEA and the White House with a shout-out to the recently-concluded campaign:
I, first of all, want to thank everyone for being on the call and really just a deep, deep appreciation for all the work you all put into the campaign for the two plus years we all worked together…And, you know, we won and that’s exciting, and now we have to take all that energy and make it really meaningful.
Ms. Wicks main focus, however, is on the Serve.Gov portal, and the United We Serve program. They are leading initiatives of the Obama Administration to promote ‘national service.’ As Dana Loesch has reported at Big Government, the Serve.Gov portal funnels volunteers to programs supported by ACORN and other leftist organizations. Ms. Wicks seems to acknowledge this by noting during the call (emphasis added):
We wanted to connect folks with local non-profit organizations in their community. We wanted them to connect with local city council members or local elected officials. We wanted to connect them to federal agencies, with labor unions, progressive groups, face groups, women’s groups, you name it. [you name it, as long as it is part of the center-left movement.]
Throughout her time on the call, Ms. Wicks lays out the vision for the President’s ‘national service’ initiative. Remember, this is a government-sponsored initiative, complete with non-partisan federal agency oversight and taxpayer-funded web resources. There are three main problems with the vision articulated by Ms. Wicks. To summarize:
1. The volunteer initiative are focused on only four areas, as explained by Ms. Wicks:
One is health care. Obviously, that is a big issue…Second was energy and environment…Third was education…and then the fourth category was community renewal.
Americans coming to the Serve.Gov portal would be steered into one of these four areas. Repeatedly throughout the call, it is mentioned that these are the four categories for the national service campaign. Americans who responded to the President’s call to volunteer would be ‘nudged’ into one of these areas. Each of these has an obvious political component towards the President’s legislative initiatives.  Â
2. The initiative seems to mimic a campaign operation. As explained by Ms. Wicks:
And then another tool we’ve been working on is on the ground presence. We obviously don’t have the kind of field staff that we were used to in terms of producing events and encouraging local contacts, but we’re partnering with national organizations, local affiliates across the country and with Americorps members, we have been able to generate this sort of on-the-ground enthusiasm…
This is really close to propaganda. It is hard to see why a focus of a ‘national service’ initiative should actively concern itself with an ability to mobilize large numbers of grass-roots activists for individual events. It is interesting that Ms. Wicks sees this as something to make up for their lack of the large ‘field staff’ that you would have in a presidential campaign.
3. The initiative seems not only focused on very specific issue areas, but, as noted above, the possible channels for ‘volunteering’ have a strong leftist bent. As Ms. Wicks explained, their strategy is to match up volunteers with either government agencies, elected officials, labor unions or progressive groups. Not only are they restricting the issues promoted at the government-operated Serve.Gov, they are restricting the manners in which one can engage those issues.
When Ms. Wicks is finished with her call, she turns the call over to Nell Abernathy, Director of Outreach of the Corporation of National and Community Service, the independent agency that is the parent of the President’s “United We Serve†initiative. In starting her remarks, this official from an independent, non-partisan federal agency describes her role as follows:
This will sound very familiar to many of you, we’ve basically been working to do this using the same tools we found so successful in the campaign,
She went on to note:
So our primary goal here is to ask those people and arm them with the skills and tools they need to really do what they’re already doing but do it as effectively as possible…
After a bit more rhetoric, Ms. Abernathy turns the call over to Mr. Sargent, but states that she will stay on the call until the end. Mr. Sargent procedes to urge the artists to engage on the President’s initiatives:
This is all being sorted out. We are participating in history as its being made. So bear with us as we learn the language so that we can speak with each other safely and we can really work together to move the needle and get stuff done.
When Mr. Sargent is finished, he turns the call back over to Mr. Skolnik. After closing remarks, there follows a period of Q & A. One of the callers asks about the relationship between Serve.Gov, the government-run portal for national service and Organizing for America, the Obama campaign arm now housed at the DNC. Ms. Abernathy, a public official with the independent federal agency, the Corporation for National and Community Service interjects herself into the question. It is worth reviewing her extended remarks:
Yeah, I can address that a little bit, and the reason only a little bit is largely because of my role at a federal agency, I’m precluded from going too far down the specific steps what people can do to advocate…We use the techniques, organizing strategies, because basically they’re both run by people from the campaign…So, if you’re interested in getting involved with OFA that’s run through the DNC now, I could probably put you in – I could help you with who to contact. I could get that information to Michael [Skolnik] and he could get it out.
Mr. Skolnik immediately follows up by noting that:
Well, I can speak to that because fortunately, or unfortunately, I don’t work for the government…
Mr. Skolnik then speaks of very political matters. Ms. Abernathy, who is clearly still on the call, doesn’t stop him, in spite of the fact that she is a government official and that government entities organized the call.
Throughout the call, the government officials hint strongly to the artists—most of whom are federal grant recipients—that they are needed to promote the Administration’s national service initiatives. There is a lot of rich detail in the full audio recording, but the basic facts are simple—and troubling. To summarize:
The White House and NEA organized a call of former Obama campaign supporters from the art community, most of whom recently have received federal funding.
- These artists are reminded of the great work they did during the campaign and urged to do similar work to promote the President’s agenda.
- They are also asked to support the President’s initiative for ‘national service.’ They are told that their art can inspire people to participate.
- The ‘national service’ agenda will funnel people into four critical areas: health care, environment, education and community renewal
- The organizations recommended to those wishing to volunteer will be government agencies, politicians, labor unions and progressive groups
Within two days of the conference call, all 21 artistic organizations participating released statements endorsing the President’s health care reform initiative.
The lead White House official heading up the effort is a long-time leftist activist, with deep ties to ACORN and a major labor union.

House GOP to Obama: Cut the ACORN Roots Now

Last night, 83 members of the United States Senate went on record to prohibit ACORN from collecting any federal funds. Tonight, over 130 members of the House of Representatives sent a letter to President Obama, asking him to disclose and terminate all federal funding to ACORN.
That leaves 305 members of the House who are silent. If you want to find out whether your Congressman has taken a stand against an organization whose employees are eager to facilitate a child prostitution ring, call the House switchboard at 202-224-3121.
As James O’Keefe noted in his latest post, “Keep on the pressure. Never let up.”
